ePrivacy Regulation Destined for a 2021 Start Date?
The Romanian Presidency has released the Provisional agendas for Council meetings during the first half of 2019. It is our first glimpse into the ePrivacy Regulation as speculation continues as to when ePR compliance requirements may begin.
The Telecommunications Council is scheduled to undertake legislative deliberations on the ePrivacy Regulation on June 7, 2019. Even if an agreement is reached on the text of the measure to repeal the ePrivacy Directive and replace it with ePR, the finalization of the new privacy regulation and an expected implementation period of at least one year is likely to push the start of enforcement back into 2021 at the earliest.
The TTE Council last met on the ePrivacy Regulation on December 4th and an Article 64 opinion on the obligations and overlap of the General Data Protection Regulation (GDPR) and ePrivacy was on the agenda for the Fifth Plenary. Although there have been a number of high profile calls for movement in the ePrivacy negotiations, the EU has failed so far to reach consensus on measures that were hoped to go into effect at the same time as GDPR in May 2018.
The lack of consensus has left the draft regulation up in the air, and no guarantee that an effective data of 2021 is more likely than not. There was even a report last year that Germany might push for a two year implementation period, which would delay the start of these privacy protections even farther.
The ePrivacy Regulation is going to replace the ePrivacy Directive, which is best known for the cookie notice banners required on websites by the section often referred to as the EU cookie law.
