EDPS Urges Adoption of ePrivacy Regulation
The European Data Protection Supervisor urged adoption of the ePrivacy Regulation (ePR) in a blog post last week titled, “The urgent case for a new ePrivacy law”.
The EDPS called the proposed ePR “crucial to protect the fundamental rights to privacy and the protection of personal data in the digital age.” He said there is “a clear and urgent need to close … gaps [between electronic communications services and information society services] and to strengthen the protection of privacy and security of online communications.”
The four overarching themes of the blog post are:
1. The GDPR regulates data protection, not the privacy of communications.
2. GDPR is not enough to change the predominant business model of surveillance.
3. Not all communications providers are required to give people control over their most intimate data.
4. ePrivacy will help fix, not exacerbate, digital market imbalances.
He urged an even higher level of protection for communications over the protections of GDPR “given the importance of the principle of communications and the particularly sensitive nature of metadata.” He also asked the legislative body to act now rather than later: “there is no excuse for not agreeing on the ePrivacy Regulation under the present legislature and to risk an even less certain outcome in the year or years to come.”
Clarip is closely follow the possible changes to the current ePrivacy Directive in the European Union and will bring you more information when it is available. With an expected implementation period of at least a year, it seems likely at this point that the ePrivacy Regulation will go into effect for enforcement in 2020 at the earliest.
