Best States for Online Privacy
California’s passage of the most sweeping data privacy and protection law in the U.S. last month has put it back on top of the list of the state’s with the best online privacy protections, according to Comparitech. They are a website that researches and reviews consumer tech products and services, and they updated their list of the best states in the United States for the protection of online privacy for 2018 last week. In 2017, Delaware was #1.
Before we get to the list of the top states, it is worth briefly noting the key trends from the last year identified by Comparitech:
– Every state has a data breach notification law.
– The definition of personally identifiable information is being expanded in many states.
– California just passed the California Consumer Privacy Act.
– Maine is the only state to prohibit law enforcement from tracking a location using GPS built into phones and computers.
– Illinois is the only state to specifically protect biometric data.
They added six new criteria in their privacy assessment of the about the laws governing privacy protections by companies and law enforcement. These were:
– The ability to opt out of third-party data sharing
– The right to delete personal data
– The right to access
– Law enforcement access to personal data held by service providers
– Tracking of someone’s location via GPS
– Laws to protect biometric data
