Roadmap to Biometric Governance Readiness

As more organizations collect and process biometric data, there is a host of new privacy laws and regulations applicable to such information. For example, under the California Consumer Privacy Act (CCPA), the most comprehensive privacy law in the United States, consumers have rights to access, delete, and opt out of sale of biometric information, and companies have an obligation to implement and maintain reasonable security procedures and practices to protect biometric information. Under the Illinois Biometric Information Privacy Act (BIPA), companies must, among other obligations, inform data subjects that biometric data is being collected and stored and must obtain written consent from data subjects before collecting biometric information. BIPA has already resulted in over 200 class action lawsuits, including against companies outside Illinois. Other states which regulate biometric information include Washington, Texas and New York.
