Get Ready for the GDPR Cookie Monster

As I am the father of three children, ages 6 and under, the past few years have largely been a blur, but there remains one constant in my life and that is, of all things, Sesame Street!  Not a day has gone by in these last 6+ years in which Elmo, Big Bird and Cookie Monster were not also omnipresent.  Thus, it was with a sense of awakening last week that I watched Sesame Street and had an epiphany of what I should blog about this week –  that thing that connects Sesame Street and GDPR.  I am, of course, talking about COOKIES!

“By using this site, you accept cookies…”  For anyone that has used the internet, the aforementioned statement is largely omnipresent.  Unfortunately, as an American that values convenience, oftentimes at the expense of privacy, I have almost always accepted this without a second thought.  Come May, 2018 and the imposition of GDPR, however, the paradigm will be irrevocably changed and such statements are no longer sufficient.  According to the GDPR regulation, such messages will no longer bind the relationship between the company and the consumer.

According to the website, IT Governance (based in the European Union), “if there is no genuine and free choice, then there is no valid consent. You must make it possible to both accept or reject cookies.”  Hereafter, the notion that companies can simply deny one access to their website if they refuse to allow cookies, (which track personal information via your browser) is legally moot.  Instead, as noted earlier, the paradigm has shifted and now companies have an onus to acquire EXPLICIT consent from consumers as it relates to cookies.  That is why you should visit Clarip!
