New Resources on the California Privacy Rights Act

California Legal Update

Californians for Consumer Privacy, the advocacy group that authored and sponsored the new California Privacy Rights Act set up a CPRA Resource Center which includes an executive summary of the CPRA; a section-by-section description of the CPRA; the full CPRA text (including versions with annotations and track changes to the CCPA); and timeline for the CPRA.

Substantively, the drafters’ “annotations” is the most interesting feature of this resource. The CPRA, adopted on the state referendum, did not go through a legislative process and therefore there is no legislative history which accompanies other legislation. When the statutory language is unclear or ambiguous, lawyers and courts often look to legislative history to understand the legislative intent.

Although the CPRA annotations might not have the same legal significance as the legislative history, they might still be helpful by giving some insight into the CPRA drafters’ thinking.
