Alaska Introduces Consumer Data Privacy Act

On March 31, 2021, Alaska Governor Mike Dunleavy introduced the Alaska Consumer Data Privacy Act (SB 116, HB 159).

The Act contains the following privacy rights:

  • The Right to Know: the right to know when businesses are collecting consumers’ personal information.
  • The Right to Disclosure: the right to learn what information businesses have collected about consumers for the last five years and whether businesses have sold or disclosed that information to third parties.
  • The Right to Delete: the right to request that businesses delete any personal information that has been collected about consumers within the last five years.
  • Right to opt-out: the right to prevent businesses from selling consumers’ personal information.

Additionally, the bill provides that personal information of Alaskans is protected from monetization by businesses that consumers have never interacted with and will protect the personal information of minors, requiring parental or guardian approval before the information of a minor may be sold.

A violation of the Consumer Data Privacy Act would be an unfair or deceptive act or practice under the State’s consumer protection statute.  Consumers would be able to recover damages for unauthorized access, destruction, use, modification, or disclosure of their personal information.

If enacted, the Act will take effect on January 1, 2023.
