Florida House of Representatives Approves Privacy Bill

On April 21, 2021, Florida moved one step closer to becoming the third state in the nation (after California and Virginia) to enact a comprehensive privacy legislation.

The Florida House of Representatives has almost unanimously passed HB 969, a version of the privacy bill that would impose the CCPA-like compliance obligations on companies and create a broad private right of action for data breaches and companies’ failure to comply with the data subject requests to delete and correct information and to opt out of its sale.  The bill would also allow for attorney’s fees and costs if the consumers prevail in their litigation with the companies.

Next week, the Florida Senate is scheduled to consider SB 1734, a version of the privacy bill that does not contain a private right of action and would provide for the privacy law to be enforced by the State Attorney General.  If the Senate passes SB 1734, the legislators will need to reconcile the two versions before the end of the legislative session on March 30.
