Article 28 of ePrivacy Regulation: Monitoring and Evaluation Clause (Proposed Text)
The proposed text for ePrivacy Regulation Article 1 from the 4th of May, 2018 is below, covering the monitoring and evaluation clause. This will likely change in the next month or two as they are meeting to discuss the changes to the current ePrivacy Directive. We will update accordingly. Negotiations continue about the precise text and the current version gives one year from the date of entry into force for implementation. We will post the full text when it is available.
Article 28: Monitoring and evaluation clause
By [1 January 2018] at the latest, the Commission shall establish a detailed programme for monitoring the effectiveness of this Regulation.
No later than three years after the date of application of this Regulation, and every three years thereafter, the Commission shall carry out an evaluation of this Regulation and present the main findings to the European Parliament, the Council and the European Economic and Social Committee. The evaluation shall, where appropriate, inform a proposal for the amendment or repeal of this Regulation in light of legal, technical or economic developments.
