Article 22 of ePrivacy Regulation: Right to Compensation and Liability (Proposed Text)
The proposed text for ePrivacy Regulation Article 22 from the 4th of May, 2018 is below, covering the right to compensation and liability. This will likely change in the next month or two as they are meeting to discuss the changes to the current ePrivacy Directive. We will update accordingly. Negotiations continue about the precise text and the current version gives one year from the date of entry into force for implementation. We will post the full text when it is available.
Article 22: Right to compensation and liability
Any end-user of electronic communications services who has suffered material or non-material damage as a result of an infringement of this Regulation shall have the right to receive compensation from the infringer for the damage suffered in accordance with Article 82 of Regulation (EU) 2016/679.
