United States: State-Level AI Privacy Laws

- The Colorado Artificial Intelligence Act (CAIA): The CAIA, signed into law on May 17, 2024, is the first comprehensive U.S. AI law targeting “high-risk artificial intelligence systems.” The Act aims to ensure responsible AI development and deployment, focusing on transparency, accountability, and protection of individual rights. The law applies to all businesses in Colorado using high-risk AI systems, regardless of consumer numbers. Key provisions include:
- Risk-Based Classification: High-risk AI systems, which include those used in education, employment, finance, government services, healthcare, housing, insurance, and legal services, are subject to stringent requirements. Low-risk systems face fewer regulations. The law excludes systems performing narrow tasks or those used in cybersecurity and spam filtering.
- Transparency and Accountability: Organizations must provide clear information to users and conduct algorithmic impact assessments. Large companies must implement risk management policies and make public summaries of deployed systems and their data usage.
- Algorithmic Discrimination: Developers and deployers must avoid unlawful differential treatment based on various classifications. However, self-testing and diversity efforts are exempt.

- Effective May 1, 2024, Utah introduces the AI Policy Act (AI Act), amending the Utah Consumer Privacy Act (UCPA) and Utah Consumer Sales Practices Act (UCSPA) to enhance AI-related consumer protections. Key changes include explicit definitions and allowances for synthetic data—artificial data mimicking statistical properties of real data without containing personal details. This promotes privacy while enabling businesses to use synthetic data without it being classified as personal data.
- The amendments mandate transparency for AI interactions, requiring clear disclosures when consumers engage with generative AI, especially in regulated occupations. Additionally, organizations are liable for AI-related consumer protection violations. A second bill mandates AI-generated political content to be clearly marked and establishes harsher penalties for AI-facilitated crimes.
